TERMS OF SERVICE

1. Organizer

The Festival is organized by:

Burning Feet Festival

Jordan Hunter

Kolonennstr 34, 10829 Berlin



2. Eligibility

Participants must be at least 18 years old to attend the Festival.



3. Nature of the Event

All Festival activities, including classes and social dances, are recreational. Their purpose is to promote dance, physical activity, and cultural appreciation of swing and African-American dance traditions.Participation does not grant any professional qualification or certification.



4. Registration

Participants apply by completing the official online registration form provided by the Organizer.



5. Conditional Acceptance

After registration, the Organizer may send a conditional confirmation, including payment instructions.



6. Final Confirmation & Contract

Registration is only considered confirmed once full or partial payment (as required) has been received. At that point, a binding agreement is formed between the Participant and the Organizer.



7. Payment Deadline

If the Participant does not complete the payment within the specified timeframe, the Organizer reserves the right to cancel the registration.



8. Cancellation & Refund Policy

Payments are non-refundable, unless explicitly stated otherwise. By completing payment, the Participant acknowledges that they waive the right to withdraw from the contract, in accordance with applicable consumer protection laws related to event services.



9. Ticket Transfers

  • Party Pass Transfers: Participants may transfer a Party Pass to another person, provided that:

    • The Organizer is informed

    • The new participant completes registration

  • Full Pass Transfers: Full Pass transfers are allowed only if:

    • Approved by the Organizer

    • The new participant registers

    • The same role (leader/follower) and level are maintained



10. Participant Limits

Registrations are processed in order of submission, subject to capacity limits.



11. Partner Registrations

The Organizer may prioritize participants registering with a partner.



12. Role Balance

To maintain a balanced event, registrations may be conditionally accepted based on leader/follower ratios.



13. Waiting List

Participants who cannot be immediately accepted may be placed on a waiting list.



14. Physical Responsibility

Participants acknowledge that dance activities are physically demanding and may cause fatigue or injury. Each participant is responsible for assessing their own fitness to participate.



15. Liability Disclaimer

The Organizer is not responsible for:

  • Injuries or physical strain

  • Accidents occurring during the Festival



16. Personal Property

The Organizer is not liable for any:

  • Lost

  • Stolen

  • Damaged personal belongings



17. Program Changes

The Organizer reserves the right to modify:

  • Schedule

  • Locations

  • Instructors or performers

Changes may occur before or during the Festival.



18. Image & Media Rights

By attending the Festival, participants agree that they may be photographed or recorded.

The Organizer may use this material for promotional purposes, including:

  • Website and social media

  • Marketing and advertising

  • Printed or digital materials

This usage is granted free of charge and without time or geographic limitations.



19. Force Majeure

The Organizer may cancel or modify the Festival due to circumstances beyond their control (e.g. natural disasters, government restrictions, pandemics).

In such cases, liability is limited to a refund of participation fees, if applicable.



20. Conduct & Removal

The Organizer reserves the right to remove any participant without refund if they:

  • Disrupt the event

  • Appear under the influence of alcohol or drugs

  • Violate rules or safety standards



21. Anti-Harassment Policy

Harassment of any kind will not be tolerated.

This includes (but is not limited to):

  • Verbal abuse

  • Unwanted physical contact

  • Sexual harassment

  • Intimidation or stalking

  • Disruptive behavior

Violations may result in immediate removal without refund.



22. Community Responsibility

Participants are encouraged to help maintain a safe and respectful environment by reporting inappropriate behavior to the Organizer.



23. Data Protection (GDPR)

By registering, participants consent to the processing of their personal data for the purpose of:

  • Event organization

  • Communication related to the Festival

Data will be handled in accordance with EU Regulation 2016/679 (GDPR).



24. Additional Data Use

If personal data is to be used for purposes beyond event organization (e.g. marketing), explicit consent will be requested separately.



25. Health & Infectious Diseases

Participants confirm that they are not experiencing symptoms of infectious illness at the time of attending the Festival.

Participants acknowledge:

  • Attendance involves close contact with others

  • There is an inherent risk of infection

The Organizer is not liable for illness contracted during or around the Festival.

Participants agree to follow any health and safety guidelines issued by authorities or the Organizer.



26. Acceptance of Terms

By completing registration, the Participant confirms that they:

  • Have read and understood these Terms & Conditions

  • Agree to comply with all provisions
